Privacy Policy

Who We Are

This Privacy Policy applies to BrandFusion (trade name), operating as a proprietorship business under its legal owner name
For purposes of this Policy, “BrandFusion” includes its operational divisions and sub-brands, which may include Urban Reels and Icon Weddings, where relevant. We provide creative, branding, production, and marketing services to clients in India, and may work with clients internationally.

What This Policy Covers

This Policy explains how we collect, use, store, and share personal data in connection with:

  • Client and project communications

  • Contracts, MOUs, and agreements

  • Campaign creation and management

  • Marketing and portfolio showcasing

  • Legal compliance under applicable laws, including the DPDP Act, 2023 and the Copyright Act, 1957

What We Collect

We may collect the following categories of personal data from clients, their representatives, and associated parties:

  • Identity and contact details (name, email, phone number, address)

  • Business information (company name, GST number, trade name)

  • Project assets provided by the client (photos, videos, scripts, brand guidelines, logos, etc.)

  • Access credentials voluntarily provided (social media logins, cloud storage links)

  • Communication history (emails, calls, messages, meeting notes)

  • Information submitted via website forms, email, WhatsApp, or other channels

  • Cookies or tracking data, where applicable (future implementation may include analytics and pixels via Wix or other platforms)

Legal Basis for Processing

Under the DPDP Act, our primary basis for processing is your consent, provided when you engage us, share information, or sign our MOU/contract.
We may also process personal data without fresh consent when:

  • It is necessary for completing a business transaction through GST invoicing

  • It is required to meet limited legal compliance obligations under this Policy

  • Our privacy commitments remain the same whether invoicing is taxed or untaxed, though BrandFusion always prefers invoicing via GST.

How We Use Personal Data

We may use your personal data for:

  • Delivering our services as agreed in the MOU or contract

  • Internal administration and communication with you

  • Self-marketing and promotion of BrandFusion’s work, including portfolio publication (see Section 8)

  • Marketing on your behalf (campaign execution)

  • Invoicing, payment collection, and accounting

  • Improving our services and internal processes

  • Legal compliance and dispute resolution, where necessary

Sharing Personal Data

We may share your data with:

  • Freelancers, subcontractors, and collaborators engaged for your project

  • SaaS and technology providers (cloud storage, editing tools, email providers)

  • Legal, accounting, or tax consultants, when needed

All such parties are bound by confidentiality and contractual obligations.
BrandFusion will take all reasonable steps to ensure information is kept private and used only for the intended scope. Any misuse beyond our control is not our responsibility.

Portfolio and Marketing Use

By engaging BrandFusion, you grant us a perpetual, worldwide, royalty-free license to display, reproduce, and share deliverables and related project materials we create for you for self-marketing, publicity, and portfolio purposes.
This applies across all formats—digital, print, events, and presentations—and is non-negotiable unless restricted by law or NDA.
This license does not extend to your unrelated confidential information or trade secrets.

Storage and Retention

  • Project files are stored on SSDs and/or cloud systems.

  • Standard retention: 6 months post-delivery, unless otherwise agreed.

  • Extended storage beyond this period is chargeable.

  • Upon request and settlement of dues, files may be deleted before the retention period ends.

Children’s Data

We may, at times, work on projects involving minors (e.g., family events). In such cases:

  • Parental or guardian consent will be obtained before processing personal data of minors.

  • This may vary depending on project budgets and requirements.

Your Rights

You may request:

  • Access to a summary of your personal data we hold

  • Correction or updating of inaccurate information

  • Deletion of your personal data, except where retention is required for legal or operational reasons

Requests cannot override our marketing and portfolio rights (Section 8), especially where BrandFusion has invested resources into campaigns.

International Data Transfers

We currently do not intentionally store or process data outside India, but our cloud providers may store data on servers located abroad.

Security Measures

We implement reasonable technical and organisational safeguards, including:

  • Controlled access to data

  • Use of password-protected systems and secure cloud services

  • Internal confidentiality practices for all team members and contractors

Indemnity for Client-Provided Assets

The Client warrants that all materials, data, and assets provided to BrandFusion are owned by the Client or licensed for use.
The Client shall indemnify, defend, and hold harmless BrandFusion, its owner, employees, and contractors from any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from allegations that the Client’s materials infringe intellectual property rights, breach confidentiality, violate the DPDP Act, or cause harm to any third party.
This indemnity survives the immediate termination of any contract or project.

We may update this Policy at the discretion of the company, with changes posted on our website and/or communicated via email. Continued use of our services after updates means you accept the revised Policy.

Governing Law

This Policy and any disputes arising from it are governed by the laws of India, including the DPDP Act, 2023 and the Copyright Act, 1957.
